General Terms and Conditions of Online Sale
These terms of sale are entered into between the company Ballerina-créations (hereinafter referred to as "B") and any natural or legal person wishing to make a purchase via B's website (hereinafter referred to as "the Buyer").
Purpose
These terms of sale define the contractual relationship between B and the Buyer, as well as the conditions applicable to any purchase made through B's online store, whether the Buyer is a professional or a consumer. Purchasing one or more items through this site implies the Buyer's unreserved acceptance of these terms of sale. These terms of sale shall prevail over any other general or specific terms not expressly agreed to by B. B reserves the right to modify its terms of sale at any time. In such cases, the applicable terms will be those in effect on the date the Buyer places the order.
Characteristics of the items offered
The items offered are those listed in the catalogue published on B's website. Some items are offered subject to stock availability. Each product is accompanied by a description provided by the supplier. The photographs in the catalogue are as accurate as possible but cannot guarantee a perfect match with the product offered, particularly regarding colors.
Prices
The prices listed in the catalogue are in euros and include all taxes (TTC). B reserves the right to modify its prices at any time; however, the price listed in the catalogue on the day of the order shall be the only one applicable to the Buyer. The prices indicated do not include order processing, transport, or delivery costs for orders placed within the geographical areas specified below.
Geographic Scope
Online sales of the items featured on the site are reserved for buyers residing in France, the French Overseas Departments and Territories (DOM-TOM), Monaco, and any other country worldwide, for deliveries to these geographic areas.
Orders
Buyers wishing to purchase one or more items must: - complete the identification form, providing all requested contact details; - validate their order after reviewing it; - make the payment in accordance with the stipulated terms; - confirm their order and payment. Confirming the order constitutes acceptance of these terms of sale, acknowledgment of full awareness thereof, and a waiver of the right to rely on one's own purchase terms or any other conditions. All data provided and the recorded confirmation shall serve as proof of the transaction. The confirmation shall constitute a signature and acceptance of the transactions performed. The seller will send confirmation of the recorded order via email.
Right of Withdrawal
Buyers who are private individuals (non-professionals) have a seven-day withdrawal period, starting from the delivery of their order, to return one or more items to the seller for an exchange or refund without penalty, with the exception of return shipping costs.
Payment Terms
Payment is due upon ordering. Payments shall be made by bank card via the secure ............ system, which utilizes the SSL (Secure Socket Layer) protocol; this ensures that transmitted information is encrypted by software and cannot be accessed by third parties during network transmission. The buyer's account will be debited at the time the order is placed. A paper invoice will be sent to the buyer upon request.
Delivery
Deliveries are made to the address specified in the order form, provided it falls within the agreed geographical area. Risk passes to the buyer the moment the products leave B's premises. In the event of damage during transit, a reasoned complaint must be lodged with the carrier within three days of delivery. Delivery times are indicative only; please allow 6 to 8 days for order processing and shipment.
Warranty
All products supplied by the seller are covered by the statutory warranty provided for in Articles 1641 et seq. of the Civil Code. In the event of non-conformity of a sold product, it may be returned to the seller, who will accept the return and issue a refund. All claims or refund requests must be submitted by mail to the following address: 16 avenue de la mer, 83270 Saint-Cyr-sur-mer, or by e-mail, within 14 days.
Liability
In the online sales process, the seller is bound only by an obligation of means; the seller shall not be held liable for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption, or other unintended issues.
Intellectual Property
All elements of B's website are and remain the exclusive intellectual property of B. No one is authorized to reproduce, exploit, redistribute, or use—for any purpose whatsoever, even in part—any elements of the site, whether software, visual, or audio. Any simple link or hyperlink is strictly prohibited without the express written consent of B.
Personal Data
In accordance with the Data Protection Act of January 6, 1978 (Loi relative à l'informatique, aux fichiers et aux libertés), personal information concerning buyers may be subject to automated processing. B reserves the right to collect information about buyers, including through the use of cookies, and, at its discretion, to share the collected information with commercial partners. Buyers may object to the disclosure of their contact details by notifying B. Likewise, users have the right to access and rectify data concerning them, in accordance with the Act of January 6, 1978.
Archiving – Proof
B will archive purchase orders and invoices on a reliable and durable medium constituting a true copy, in accordance with the provisions of Article 1348 of the Civil Code. B's computerized records shall be considered by the parties as proof of communications, orders, payments, and transactions between the parties.
Dispute Resolution
These online sales conditions are governed by French law. In the event of a dispute, jurisdiction is assigned to the competent courts, notwithstanding multiple defendants or third-party claims.
